This policy governs the Services & Equipment Rentals marketplace on CuzHens Market ("Services Marketplace"). It applies to anyone who requests, books, lists, or fulfills a service or rental through the platform — including bush hogging, fence work, tractor work, tree removal, livestock hauling, welding, equipment rentals, and any related on-property work.
By submitting a service request, booking a service, or booking an equipment rental on CuzHens Market, you agree to this policy in full, including the Liability Waiver in Section 6.
1. CuzHens is a neutral venue
CuzHens Market is an online marketplace. We are not a contractor, equipment rental company, broker, employer, insurer, or licensing authority. We do not perform work, do not own equipment, do not supervise providers, do not verify on-site safety, and do not guarantee outcomes. All services and rentals are performed by independent third-party providers ("Providers") who set their own pricing, scope, schedule, and terms.
2. The contract is between Customer and Provider
When you (the "Customer") request a service or book a rental from a Provider through CuzHens, the resulting contract is exclusively between you and that Provider. CuzHens is not a party to that contract. We do not enforce contracts, mediate disputes beyond our best-effort role, or hold any provider out as our agent, partner, employee, contractor, or licensee.
3. Providers are responsible for their own work
Providers represent and warrant that, at minimum:
- They hold all licenses, permits, certifications, and insurance required by applicable federal, state, and local law for the work they offer.
- Their equipment is in safe operating condition and properly maintained.
- They comply with OSHA, DOT, EPA, and any other workplace-safety regulations relevant to the work.
- They have the legal right to bring any equipment onto the Customer's property.
- They will obtain any property-owner permissions, easements, or utility-locator approvals required before starting work.
CuzHens does not verify any of the above except where we have explicitly issued a Verified Provider badge.
4. Customer responsibilities
The Customer agrees to:
- Provide an accurate description of the work site, including known hazards (utility lines, septic, well heads, livestock, pets, children, terrain, structures, soil conditions).
- Have legal authority to authorize the work on the property in question.
- Be physically present (or arrange a qualified adult representative) when work begins, unless otherwise agreed in writing.
- Keep children, pets, and uninvolved persons clear of the work area.
- Not interfere with the Provider's equipment or work in progress.
- Pay agreed amounts on the agreed schedule.
5. Equipment rentals — additional rules
For equipment rentals booked through CuzHens:
- The Customer is the operator and is responsible for the safe operation of the equipment unless the listing explicitly includes an operator.
- The Customer is responsible for any damage to the equipment beyond normal wear, theft, loss, or third-party injury arising from their operation.
- The Customer agrees to operate equipment only within its rated capacity, on approved terrain, and only for the purposes described in the listing.
- The Customer must return equipment in the condition received minus normal wear and at the agreed time. Late returns may incur additional charges set by the Provider.
- The Customer must hold a valid driver's license for any equipment that legally requires one (tractors towed on public roads, large trailers, etc.).
6. LIABILITY WAIVER & ASSUMPTION OF RISK ⚠️
By submitting a service request, booking a service, or booking an equipment rental on CuzHens, the Customer expressly acknowledges and agrees to the following:
a. Inherent risk. Farm and equipment services carry inherent risks of property damage, personal injury, and death — including but not limited to flying debris, equipment failure, falling trees and limbs, fire, fuel spills, slips, falls, tractor rollover, animal-handling injury, and contact with overhead or underground utilities. The Customer knowingly and voluntarily assumes all such risks.
b. Release of CuzHens. The Customer fully releases, waives, indemnifies, and holds harmless CuzHens LLC, its affiliates, officers, directors, employees, agents, contractors, and licensors (collectively, "CuzHens Released Parties") from any and all claims, demands, losses, damages, costs (including reasonable attorneys' fees), and causes of action arising out of or related to any service or rental booked, requested, performed, or marketed through the Service — including those arising from the negligence of any party other than the CuzHens Released Parties' own gross negligence or willful misconduct.
c. Provider is not CuzHens's agent. The Customer acknowledges Providers are independent contractors, not CuzHens employees, partners, or agents, and that CuzHens cannot and does not control or supervise their work.
d. Insurance. The Customer acknowledges that CuzHens does not provide insurance covering Customer property, Customer injury, third-party injury on the property, or Provider injury on the property. The Customer is solely responsible for obtaining whatever homeowner's, farm-owner's, liability, or workers' compensation insurance the Customer deems necessary.
e. No warranty. All services and rentals are provided "AS IS" and "AS AVAILABLE" to the maximum extent permitted by law. CuzHens disclaims all warranties — express or implied — including merchantability, fitness for a particular purpose, accuracy of Provider listings, availability of Providers, and timeliness of completion.
f. Cap on damages. To the maximum extent permitted by law, CuzHens's total aggregate liability to the Customer for any and all claims arising from or related to a service request, service booking, or equipment rental shall not exceed the greater of (i) the total fees paid by the Customer to CuzHens in the 90 days preceding the claim, or (ii) USD $100.
g. Binding nature. This waiver is intended to be as broad as is allowed under Georgia law (or the applicable governing law). If any portion is held unenforceable, the remainder remains in full force.
7. CuzHens does not handle payments for off-platform work
Unless the Provider has activated CuzHens checkout for a specific listing, all payments are made directly between the Customer and the Provider, outside the platform. Disputes about pricing, refunds, scope creep, or unpaid invoices are between the Customer and Provider. CuzHens will provide reasonable assistance (logs, message history) on request but is not obligated to mediate or refund.
8. Listings, photos, and accuracy
Providers are responsible for the accuracy of every detail in their service or rental listing — including pricing, scope, photos, availability radius, certifications claimed, and equipment specifications. CuzHens may remove or edit listings that materially misrepresent the offering, but does not pre-screen every change.
9. Service Requests ("Request a Service")
When a Customer posts a Request a Service:
- The request is visible to qualified Providers in the relevant category and radius.
- Providers may submit a response with a quote, ETA, and message.
- CuzHens does not vet, recommend, or guarantee responses. It is the Customer's responsibility to verify the Provider's identity, licensure, insurance, references, and work quality before agreeing.
- Posting a request does not create an obligation between the Customer and any Provider. No contract forms until both parties agree off-platform or via the Provider's CuzHens checkout.
10. Cancellations & no-shows
- Customer-initiated cancellations are governed by the cancellation terms in the specific listing or in the message thread between Customer and Provider.
- If a Provider fails to appear without notice, please report it via the CuzHens support form so we can review the Provider's account. CuzHens cannot reimburse losses from a no-show but may suspend the Provider.
11. Verified Provider badges
Verified badges (Identity, Business, Insurance, License) signal that CuzHens has reviewed documentation submitted by the Provider as of the verification date. Badges do not constitute a guarantee, endorsement, or insurance. A Provider's underlying status may change at any time. Customers are encouraged to independently re-verify before any high-value engagement.
12. Prohibited service categories
The following are not allowed as services or rentals on the platform:
- Anything that requires a license the Provider does not actually hold (e.g. unlicensed pesticide application).
- Live-animal slaughter for resale unless performed under USDA-FSIS inspection.
- Demolition or earthworks subject to permits the Provider does not actually hold.
- Anything that violates federal, state, or local law.
We may remove categories at any time.
13. Disputes & governing law
This policy is governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Disputes between you and CuzHens that cannot be resolved informally will be heard in the state or federal courts located in Waycross, GA.
Disputes between Customer and Provider are between those parties and are not subject to CuzHens arbitration.
14. Changes to this policy
We may update this policy at any time. The "Version" stamp at the top reflects the current version. Material changes will be flagged on the relevant booking and request forms with a re-acceptance checkbox.

By checking the liability-waiver box on any service request, service booking, or equipment rental, the Customer confirms they have read, understood, and agreed to this entire policy — including the Liability Waiver in Section 6.
